A TIMELINE OF THE DANIEL PENNY CASE. A HERO IS LET FREE FROM THE CLUTCHES OF A RACIST DISTRICT ATTORNEY

Persecution of a United States Marine.  A timeline.

It was May 1st when, surrounded by other straphangers on a New York City subway, that Marine Veteran Daniel Penny found himself on the horns of a dilemma.  New Yorkers by the millions rely on the mass transit system to get to work, school, and for any other reason you can think of.  The subway is the lifeline of the country’s largest metropolis.

Keeping more than 6700 train cars running on over 700 miles of track is bad enough, but keeping the 3.6 million riders safe every day is a horse of a different color.  It’s a horse the NYPD seems incapable of riding.

No, the NYPD doesn’t do a very good job at all.  As a matter of fact, their performance is miserable.  Every day some poor schmuck gets stabbed, beaten, robbed, tossed onto the rails or stabbed to death on the subway platforms and trains.

A fellow subway straphanger, Marine Veteran Daniel Penny watched as a crazed Jordan Neely stomped around the car swinging his fists and feet through the air often barely missing others by mere inches.  He screamed karate cries and yelled out threats including, “I’m not afraid to die.” Intimating that he was ready to take life as well as lose it.

A seriously deranged and violent Neely was amping up his temper.  Stoked by the fuel of his own insanity, Neely had become a danger to everyone around him.  Moment by brief moment he became more and more erratic.  If something didn’t happen soon there would more than likely be injured or dead or both on this train.  The time had come to act.  Everyone there was in imminent danger.

Unfortunately, New Yorkers are not known for their courage under fire or for giving a damn about anybody else but themselves.  This being the case, the ball was clearly in Penny’s court.

Mere seconds before, Neely’s latest lunge had come within an inch of an elderly woman’s face causing her to slide out of her seat and onto the train floor.  That’s when the Veteran Marine Corps squad leader leapt into action.  He was smaller than Neely and Neely possessed the strength of a madman, adrenaline rushing through his veins.  Even a Marine counts to 3 before acting.

Daniel quickly subdued Neely in a submission hold.  Neely was inescapably locked in the hold, one designed to incapacitate and render an offender unconscious.  Penny did what had to be done.  As Daniel Penny flexed his muscles constricting Neely’s airway, the madman lapsed into unconsciousness at which time Penny released his grip lowering Neely’s head onto a jacket placed on the floor of the subway car.

This ‘concern amid violence’ is typical of the mercy shown by our service men and women.  Penny then stepped back from the now motionless madman, Jordan Neely.  The threat had been contained and that’s where this whole comedy of errors should have ended.

Who was this man, Jordan Neely?  He was a released mental patient with a history of psychotic breaks, extreme violence and refusal to take his medications.  Neely was a force to be dealt with, especially in public.  He was a psychotic madman hyped up on other drugs not prescribed by any doctor.  His hair trigger made him infinitely dangerous.

His release from mental care had been based on finances rather than his mental health.  The State of New York took this walking time bomb out of the crazy ward and tossed him back out onto streets.  Pulling the pin on this human grenade, New York’s mental health system unleashed him against an unsuspecting and vulnerable public.

Manhattan District Attorney, Alvin Bragg, was quick to make this an issue of race as he so often does.  He decried Penny’s actions claiming they were racially motivated.  Bragg clung to the race card simply because Neely was black and Penny was white.

Yep, the old race card is alive and well, especially in Democrat run cities like New York.  Let’s not forget that Neely, being black, enjoyed ‘protected class’ status under New York law.  This status makes virtually any attack on a protected class person, either verbal or physical, a ‘Hate Crime’.  During his career, Alvin Bragg has committed numerous abuses of office as he chases the hobgoblins of mythical ‘systemic racism’.

It was May 11th, Penny surrendered to the Manhattan District Attorney’s office.  He was facing charges of murder.  New York’s eager-to-prosecute-anyone-white District Attorney, Alvin Bragg was there waiting for him.

The process of persecution [not prosecution] had begun as the media was already whipping up a frenzy among black racists and wiggers alike.  They were out for blood.  Virtually every media outlet was making race an issue because that’s what sells papers.

It was June 15th, an almost entirely black grand jury indicted Daniel Penny on charges of 2nd Degree Manslaughter and Criminally Negligent Homicide.  Both charges were issued because as Alvin Bragg related to his colleagues, “If we can’t nail him on the 1st count we’ll get him on the 2nd.

I spoke with a clerk to the office of the District Attorney who wishes to remain anonymous.  She said,Mr. Bragg was really excited to get the Penny case.  He was still smarting from his loss to Donald Trump and wanted a showcase for his re-election.  He’s always talking about ‘Crackers’ and such.  [‘Cracker’ is a racial slur against white people] He’s say, “I got this cracker dead to rights and it’s a f__*king shame there’s no death penalty anymore.”  With the race card firmly in play Alvin Bragg’s office declared war on Daniel Penny.

It was June 28th, another fly on the wall said to me, “When Penny got bail Bragg was pissed!  He let loose with a tirade that would cause a stroke in a lesser person.  His temper is one of legend in these parts and when he’s ‘on one’ the word is ‘stay clear’.  He wanted Penny in ‘The Tombs’, the New York Jails notorious for violence and murder.  He’d laugh and say, “That cracker won’t last long down there.”  It made me sick to hear him.  I’m black and I abhor racism of any color.  And for God’s sake, that man should never have been allowed to do what he did to Mr. Penny.”

Penny’s attorneys worked day and night to have charges dismissed.  The flimsy case Alvin Bragg’s people had built up was unworthy of a trial.  Based on admittedly racist testimony and circumstantial evidence there was no real proof with which to prosecute Daniel Penny.  This was persecution, not prosecution.  Riding on the coat tails of Alvin Bragg, a judge declined to dismiss the case.

It was October 21st, a jury was seated.  It had taken weeks to find relatively neutral jurors.  In New York finding an impartial jury is like finding a 4-leaf clover on an airport runway.

Doing the best they could, defence attorneys rejected the most opinionated and racist of potential jurors.  The jury was finally seated.

It was November 1st through December 6th, The case had seated dedicated jurors who would end up reviewing hours of tape, testimony and evidence.  They took their jobs seriously and on numerous occasions demanded evidence for more scrupulous review.

It was December 6th, lacking sufficient evidence to prosecute further, the judge threw out the charge of 2nd Degree Manslaughter.  The noise from within and without the courthouse was deafening.  Racist elements of the New York public scene were calling for blood and nothing would satisfy them short of life in prison for Daniel Penny.  Their racist rants against all white folks rang through the street and the violence reached a point where police were forced to make a number of arrests.

It was December 9th, all charges against Daniel Penny were thrown out.  The state had failed to make its case and Penny became a free man.  Meanwhile, the crowd inside and outside the courtroom had grown increasingly belligerent.  Their racist chants and protests once again forced police to restore order.  Dedicated camps for Penny and those against him were ready for a fight.  Thanks to the NYPD it never advanced beyond a war of words.

In conclusion:  Much as it was with the death of George Floyd in Minnesota, competent forensic pathologists testified that Neely’s own body is what killed him.  Unlike the George Floyd case, sound medical science prevailed.

With clinical levels of different drugs and alcohol in his system and being in an advanced state of excitement, his body succumbed to the poison in his veins and a weak heart.  To the uninitiated it seemed clear that Penny had killed Neely with the choke hold.  In fact the choke hold, as physicians testified, had not contributed to Neely’s death.

Testimony from a number of straphangers [black and white] favored Penny as they testified he had saved them from harm or even death.  Straphangers everywhere praised Penny’s courage and willingness to step forward when nobody else would.  This is understandable because Penny is a Marine.

Daniel Penny is a Marine

 Marine” is a title you earn.  It cannot be bought or borrowed, nor can it be removed.  There are no “ex-marines” nor are there any “former marines’.

A Marine, unlike other servicemen and women, is under contract for life.  Even after completing his or her initial obligation of service of 2, 4, or 6 years a marine is placed on “Inactive Reserve” for the rest of his or her life.  I was called up to active duty twice after having completed my 6-year obligation.  It was when, at the age of 52, I was called up for the 3rd time but was released of my obligation due to medical disability.

We need to remember that very few people, Marines or not, will stand up and answer the call as did Daniel Penny.  I salute him, a fellow Marine, and admonish everyone to take a lesson from his story and emulate the acts of one brave man.

Daniel Penny is one of the few, the proud, the Marines.
