It cannot be justified, this bias the law holds against all those who do not fit neatly into a pigeon hole as a minority.  Be it Blacks, Hispanics, Asians, LGBTQ, etc. there is always room to deny personal freedoms and announcing that this is ‘good’ for all.

Our system sucks, and

this case shows how badly it does.
