‘DOUBLE-JEOPARDY’ PROTECTION

A Kentucky inmate who received a pardon from the outgoing governor for a 2014 murder has been charged again for the same crime by the federal government. Patrick Brian Baker, 42, was taken into custody by U.S. Marshals on Sunday for the same crime of which he had been pardoned by the governor of Kentucky.

It all began when in 1980
Joseph Paul Franklin was tried for the murder joggers in a Salt Lake City park. Click

charges of Capital Murder on 2 counts.
He was acquitted in a jury trial but, before he could even take off his
chains, he was re-arrested by US Marshals.
He was re-tried for ‘Violation of the Civil Rights’ of
those killed, and eventually sentenced to death in a Federal Court. He's dead now.
This case has become a critical benchmark
for stripping and destruction of the Fifth Amendment to the Constitution. In today’s case a man who has been charged,
tried, and convicted of a crime has received a gubernatorial pardon for that very crime. But, once pardoned and free, the Federal
Government intervened and took him into custody to stand trial for
the very same crime, the same act, of which he had already been given a pardon.
So, it seems we have a multi-tiered shelf with which the government can
‘get you’ if they want. It also seems the federal government has decided to usurp State's Rights in ignoring Kentucky's judgment of pardon.
The idea of ‘double jeopardy’ is spelled out in the Fifth Amendment to the Constitution of the United States. It says, "[N]or shall any person be subject for the same offence to be twice put in jeopardy of life or limb..." The four essential protections included are prohibitions against, for the same offence: retrial after an acquittal; retrial after a conviction;”
The purpose of this amendment is to prevent the government from repeat-prosecuting an individual until they eventually get the guilty conviction they desire. The ‘unlimited resources’ of the government allow them to ‘get’ anyone they want, the Constitution be damned!
That damned Supreme Court decision in 2019 erroneously and criminally affirmed that it is permissible under the constitution for accused individuals to separately face state and federal charges for the same crime, the same act. According to the Feds, the arrest and federal charges do not run afoul of
the constitutional principle of double jeopardy; that clause protects the
exonerated in the U.S. from being charged with the same crime twice. They also assert the
double jeopardy clause doesn't apply in this case, as the original conviction
occurred at the state level and the new charges are federal. When asked about their usurping of State Rights they had no comment. No comment means THEY ARE GUILTY!
Look closely at their
reasoning. It says they can nail you
with city, county, state, and federal windows to prosecute for the same
crime, the same act. This means that the whole
judicial system is a fraud and an assault on freedom itself. It stands for nothing!

The real tragedy is that the federal government now has the ‘court sanctioned’ tools to jail or even execute anyone they wish with virtual impunity from repercussion and a ‘blank cheque’ with which to do it.
